These Terms of Use (the "Terms") are an agreement between you and SVO Technologies LLC ("we", "us", or "our") and govern your use of the Pood mobile application (the "App") and the website at https://pood.fit (together, the "Service"). By downloading or using the Service, you agree to these Terms. If you do not agree, don't use the Service.
What the App is
Pood is training software. It records the kettlebell workouts you choose to log and offers program structures and progression suggestions based on the numbers you enter. It is not a medical device, it provides no medical advice, and its suggestions are starting points — not prescriptions.
Health & safety
Kettlebell training is vigorous physical exercise, and like all exercise it carries inherent risk of injury. By using the App, you acknowledge and accept that risk. In particular:
- Talk to your physician first. Consult a doctor before beginning this or any training program, especially if you are pregnant, have a heart condition, prior injuries, or any other condition that could be affected by exercise.
- Stop if something is wrong. Stop training immediately if you experience pain, dizziness, faintness, shortness of breath, or chest discomfort, and seek medical attention.
- You make the call. Progression suggestions are computed only from the numbers you log. They know nothing about your health, technique, or circumstances. You alone decide what weight, volume, and intensity are safe for you, and you assume full responsibility for those decisions.
Subscriptions and purchases
- Premium is available as a monthly or annual subscription, or as a one-time lifetime purchase. All billing is handled by Apple through your App Store account; we never see your payment details.
- Subscriptions renew automatically until canceled at least 24 hours before the end of the current period. You can cancel anytime in your App Store subscription settings.
- If a plan includes a free trial, the subscription begins (and billing starts) when the trial ends, unless you cancel before then.
- Refunds are handled by Apple under the App Store's terms.
- Bought Premium in Kettlebell Tracker (v1)? That unlock is yours for good — use Restore Purchases in the App to pick it up.
Your data
Your training data is stored on your device — there are no accounts and we run no servers, as described in our Privacy Policy. That design also means you are responsible for keeping your device backed up: if the device and its backups are lost, we have no copy of your data to recover.
License and acceptable use
We grant you a personal, non-transferable, non-exclusive license to use the App on Apple devices you own or control, as permitted by the App Store terms. You agree to use the Service only for lawful purposes, and not to copy, modify, redistribute, or reverse engineer it except where the law expressly permits.
Disclaimer of warranties
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or fit for your particular purpose.
Limitation of liability
To the fullest extent permitted by law, SVO Technologies LLC will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service — including injuries or health events connected to your training decisions, or loss of data — and our total liability for all claims will not exceed the amount you paid us in the twelve months before the claim arose. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
Changes
We may update these Terms as the Service evolves. When we do, we will update this page and revise the date above; continuing to use the Service after a change means you accept the revised Terms.
Governing law
These Terms are governed by the laws of the United States and of the state in which SVO Technologies LLC is organized, without regard to conflict-of-law rules.
